The Statutory Frame

Several statutory texts apply to tortoises. To facilitate the reading, we shall remember three main items:


The status of dangerousness of the species

Certain species are considered as dangerous and are the object of specific arrangements, as the compulsory marking: it is in particular about species in which the width of the mouth in adulthood is superior or equal to 4 centimeters and belonging to certain families of tortoises.

Status of protection of species

The tortoises, as all other orders of reptiles are the object of protective measures. We distinguish three types of protection:

International

It is the application of the agreements of Washington taken for the regulations of the international trade of the wild species (CITES). The species are listed in three Appendices (I, II and III) according to their degree of protection.

European

It's the translation in the European legislations of the CITES. The European regulamentation lists the species in four Appendices (A, B, C and D) according to their degree of protection.
The advantage of this European regulamentation is because it reminds of the appendices of CITES and its reading makes not compulsory read the Agreement of Washington. So a species registered on the European regulamentation "II B" means that the species is represented in the Annexe II of CITES and in the annexe B of the european reglementation.

National

Certain species of tortoises are entirely protected on the national territory and in French Guyana by extension.

About the Detention
